Seminar: History of modern islamic law
This study day focuses on the cultures and legal and normative heritage of the Muslim worlds and their transformations from the 18th century to the present, following the emergence and universalization of a particular positivist legal language, under the influence of imperialist pressure or through a process of voluntary integration. It will analyse practices linked to the phenomena of legal adaptation, hybridization and innovation within the framework of a "glocalised" world, i.e. subject to the dual dynamics of globalisation and its local translations.
The main hypothesis is that the influence of European concepts has led to an unprecedented undertaking of positivist re-reading of the Islamic sharia.
